TERMS OF SERVICE

These Terms of Service govern your use of www.brixkrieg.com and any purchase you make from us. By using the site or placing an order, you agree to these Terms.

1. WHO WE ARE

BrixKrieg is operated by VatiVita LLC ("BrixKrieg," "we," "us," or "our"). We sell WWII military building block kits, imported factory-direct and shipped from warehouses in the United States. You can reach us at tony@brixkrieg.com or 775-800-6464.

2. TEXT MESSAGE (SMS) PROGRAM

2.1 Consent. If you give us your mobile number and opt in, you agree to receive marketing and order-related text messages from BrixKrieg, including up to 8 marketing messages per month. Message and data rates may apply. Consent to texts is not a condition of purchase.

2.2 Opting out. Reply STOP to any message to stop receiving texts. You may still receive order-related texts for orders in progress. Reply HELP for help, or email tony@brixkrieg.com.

2.3 How we use your number. We use your number to process orders, provide support, send marketing you have opted into, and verify your identity. We share it only with the service providers needed to deliver messages and orders, including our messaging platform, mobile carriers, and shipping carriers. We do not sell your phone number.

2.4 Retention. We keep your number while your account is active or you remain opted in, or as required by law. You can ask us to delete it at any time.

2.5 Your rights. Depending on where you live, you may have the right to access, correct, delete, or port your data, or to opt out. Email tony@brixkrieg.com to make a request.

3. PRODUCTS, PRICING, AND AVAILABILITY

3.1 Product details. We describe piece counts, scale, materials, and features as accurately as we can. If something you receive does not match its description, tell us and we will make it right.

3.2 Availability. Products can sell out. We may offer pre-orders, may not restock every item, and may limit quantities per order.

3.3 Pricing. Prices are in U.S. dollars and can change. If we find a pricing error on your order, we will contact you, and you can continue at the correct price or cancel for a full refund.

4. ORDERS AND PAYMENT

4.1 Order acceptance. Your order is an offer to buy. We may decline or cancel any order, and if we do, you receive a full refund. Your order is accepted when it ships.

4.2 Payment. We accept major credit and debit cards, PayPal, Shop Pay, and the other payment methods offered at checkout. Payment is charged when you place your order.

4.3 Security. Payments are processed through Shopify Payments. We do not store your full card details.

5. SHIPPING

Shipping times, costs, delivery areas, and how we handle lost or damaged packages are covered in our Shipping Policy, which is part of these Terms.

6. RETURNS, REFUNDS, AND REPLACEMENT PARTS

Our 365-Day Satisfaction Guarantee and our free replacement parts promise are covered in our Refund Policy, which is part of these Terms.

7. INTELLECTUAL PROPERTY

7.1 Trademarks. The BrixKrieg name and logo are trademarks of VatiVita LLC. You may not use them without our written permission.

7.2 Our content. Our website content, photography, product descriptions, and the packaging and instruction materials we create are owned by or licensed to us and are protected by copyright.

7.3 No affiliation. BrixKrieg is not affiliated with, sponsored by, or endorsed by the LEGO Group or any other building block manufacturer. LEGO is a trademark of the LEGO Group.

8. WARRANTIES AND LIMITATION OF LIABILITY

8.1 Except for the guarantees described in our Refund Policy, and to the fullest extent permitted by law, our products and website are provided "as is," without other warranties, express or implied. We do not promise that the website will always be available, uninterrupted, or error-free.

8.2 To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

8.3 Some jurisdictions do not allow these limits. Where that is the case, our liability is limited to the fullest extent the law allows.

9. PROHIBITED USES

You agree not to use our website to break the law, upload malware, harass anyone, infringe anyone's intellectual property, impersonate anyone, attempt to access our systems without permission, or resell our products commercially without our written permission. We may refuse service or close accounts that violate these Terms.

10. AGE AND SAFETY

Our kits are intended for adults and builders 14 and older. WARNING: CHOKING HAZARD. Small parts. Not for children under 3. You must be 18 or older to place an order, or have the consent of a parent or guardian. Parents and guardians are responsible for supervising children.

11. PRIVACY

Our Privacy Policy explains how we collect and use your information and is part of these Terms. You can read it at www.brixkrieg.com/policies/privacy-policy.

12. CHANGES TO THESE TERMS

We may update these Terms at any time. Changes take effect when posted, and the date at the top will change. Using the site after an update means you accept the updated Terms. We will notify SMS subscribers of material changes to the SMS program by text or email.

13. GOVERNING LAW AND DISPUTES

13.1 These Terms are governed by the laws of the State of California, without regard to its conflict of law rules.

13.2 If you have a problem, contact us first at tony@brixkrieg.com or 775-800-6464 so we can try to resolve it informally. Any dispute we cannot resolve informally will be settled by binding arbitration administered by the American Arbitration Association. You and BrixKrieg agree to bring claims only on an individual basis, and not as part of any class or representative action.

13.3 Either party may ask a court for injunctive relief to stop infringement of intellectual property or unauthorized use of the website.

14. SEVERABILITY

If any part of these Terms is found unenforceable, the rest remains in effect.

15. ENTIRE AGREEMENT

These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, are the entire agreement between you and BrixKrieg regarding your use of the site and your purchases.
